Miami promotor sues NCC

The National Carnival Commission (NCC)  is being sued for over $3m by a Miami based manager/promoter for a breach of contract. 

In an application filed in the Port-of-Spain High Court, Diane Bissoon said she was retained by the NCC to promote the Carnival and culture of T&T by contract on May 11, 2014.  She said she also resigned her position with Cable and Wireless on the request of the NCC in order to dedicate her time fully to the commission.

In her statement Bissoon said after carrying out numerous tasks for the NCC, she was informed on July 9, 2014 that her contract was never ratified by the NCC Board and was therefore invalid. 

Bisson is seeking special damages in the sum of US$86,335.60 and/or in the alternative, damages for breach of contract in the sum of US$405,336.20 with loss of commission, pursuant to the contract, to 

be assessed.

When the matter came up for hearing before Justice Frank Seepersad in the Port-of-Spain High court on Monday, attorney for the defendant filed for an extension of time to file its defense which was granted by the court in Chambers.

 The claimant subsequently filed two applications, one, to have the court set aside its order to extend the time and the other, for judgement based on admission.

Bissoon is contending that after the action was filed, the defendant acknowledged liability and signed an agreement to that effect and based on the agreement, judgement should be entered. 

The court did not set aside its order to extend the time for the NCC to file its defense, but stayed the said order pending the determination of the applications for judgement.  

Directions were given for the filing of legal submissions and the matter was adjourned for decision on May 5, 2015.
